Acceptance of terms

By downloading or using TopBar, you agree to these terms. If you don't agree, please don't download or use the app.

These Terms of Use ("Terms") govern your access to and use of TopBar ("the app"), operated by topbarapp.com ("we", "us", or "our"). Please read them carefully before using the app.

Licence

TopBar is offered free of charge. Provided you follow these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to download and use the app on any Apple-branded device you own or control, for your own personal, non-commercial use.

This licence doesn't give you the right to sublicense, resell, or redistribute the app. Any rights not expressly granted here remain ours.

Restrictions

While using TopBar, you agree not to:

  • Copy, modify, or build derivative works from the app
  • Distribute, sell, lease, or sublicense it to anyone else
  • Reverse engineer, decompile, or disassemble the app
  • Remove or obscure any proprietary notices it contains
  • Use it for any unlawful purpose or against applicable law
  • Use it in any way that could damage or impair its operation

Disclaimer of warranties

TopBar is provided "as is" and "as available", without warranty of any kind, whether express or implied.

We don't warrant that the app will meet your requirements, run without interruption, be error-free, or be free of harmful components. We don't promise that any defects will be fixed or that the app is free of viruses or other harmful code.

You use the app entirely at your own risk. No information we provide, spoken or written, creates any warranty not expressly stated in these Terms.

Limitation of liability

To the fullest extent permitted by law, neither we nor our affiliates, officers, employees, agents, or licensors will be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, data, or goodwill — arising from:

  • Your use of or inability to use TopBar
  • Any unauthorised access to or alteration of your data
  • Any interruption or stoppage of the app's functionality
  • Any bugs, viruses, or harmful code linked to the app

This applies even if we've been advised of the possibility of such damages. Some jurisdictions don't allow certain limitations, so parts of the above may not apply to you.

macOS compatibility

TopBar is made for macOS 10.13 (High Sierra) and later. While we work to keep it compatible with new macOS releases, we can't guarantee it will function correctly on every future version of macOS.

We aren't responsible for any loss of functionality caused by macOS updates released after the current version of TopBar, though we'll make reasonable efforts to ship fixes for significant compatibility issues.

Updates to the app and terms

We may release updates to TopBar from time to time, and some may be needed to keep certain features working. We reserve the right to change or discontinue the app, temporarily or permanently, at any time without notice.

We may also revise these Terms. When we do, we'll update the date at the top of this page. Continuing to use TopBar afterwards means you accept the revised Terms. If you don't agree to them, please stop using the app.

Governing law

These Terms are governed by and interpreted in line with applicable law, without regard to conflict-of-law principles. Any disputes arising from these Terms fall under the exclusive jurisdiction of the courts of competent jurisdiction.

If any part of these Terms is found unenforceable, that part will be adjusted only as much as needed to make it enforceable, and the rest will stay in full effect.
